Terms of Use

These Terms govern your access to and use of the SleepTight mobile application and related services (the “Service”), provided by NEXALIFY LIMITED (“we,” “us,” or “our”). By downloading, accessing, or using SleepTight, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

SleepTight lets you create and manage user-confirmed sleep-time records and, when available, related written insights. The app does not measure sleep stages, diagnose conditions, or provide medical advice. The Service is for general informational and personal use only; it is not a substitute for professional medical care.

2. Eligibility and anonymous installation

You must be at least 18 years old, or the age of majority where you live if higher, to use the Service. SleepTight does not require an account or login. Synchronization uses an anonymous installation credential to authorize access to that installation’s records. You are responsible for protecting access to your device and not sharing its credential. We do not currently offer account-based record migration or recovery across installations.

3. Your use of the Service

You agree to use the Service lawfully and not to interfere with its operation, attempt unauthorized access, misuse another person’s data, reverse engineer or exploit the Service except as permitted by law, or use it to infringe another person’s rights.

4. Records and content

You retain rights you hold in information you submit. You grant us a limited, non-exclusive license to host, process, transmit, and display that information as needed to operate, secure, and support the Service. You are responsible for ensuring that you have the rights and authority to submit it. The Service may generate text based on limited inputs you authorize; generated text can be incomplete or inaccurate and should not be treated as a measurement or professional advice.

5. Subscriptions and in-app purchases

Some features may require an auto-renewing subscription purchased through Apple. If subscriptions are offered, the purchase screen and Apple’s confirmation sheet show the applicable price, billing period, trial or offer eligibility, renewal terms, and cancellation method before purchase. Payment, billing, renewal, cancellation, and refunds are subject to Apple’s terms and controls. You can manage or cancel a subscription through your Apple account settings. Deleting SleepTight records or uninstalling the app does not cancel a subscription. Restoring a verified subscription does not restore records from another installation.

6. Availability and changes

We may modify, suspend, or discontinue parts of the Service where reasonably necessary, including for maintenance, security, legal compliance, or product changes. We do not guarantee uninterrupted availability or that any generated content will always remain available.

7. Privacy

Our Privacy Policy explains how information is handled and how to contact us with a privacy request. Please review it before using the Service.

8. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available,” without warranties not expressly required by law. We do not warrant uninterrupted, error-free or medically accurate results. Nothing in these Terms excludes a consumer guarantee or liability that applicable law does not permit us to exclude.

9. Limitation of liability

To the extent permitted by applicable law, NEXALIFY LIMITED is not liable for indirect, incidental, special, consequential, exemplary, or punitive loss arising from your use of the Service. Where liability cannot lawfully be excluded, it is limited to the remedies required by applicable law.

10. Suspension and termination

You may stop using the Service at any time. We may suspend or restrict access if reasonably necessary to address a security risk, unlawful use, material breach of these Terms, or legal requirement. Ending use of the app does not itself remove information already synchronized or cancel an Apple subscription.

11. Governing law

These Terms are governed by the laws applicable to NEXALIFY LIMITED, subject to any mandatory consumer protection laws that apply where you live. Nothing in this section limits rights that cannot be waived under those laws.
